1. Agreement to These Terms
These Terms & Conditions ("Terms") govern your use of www.dchomeexpress.com your customer account, and cleaning, alteration, repair, pickup, delivery, and related services provided by Rite Cleaners (collectively, the "Services"). By using the website, creating an account, placing an order, scheduling a pickup or delivery, authorizing payment, or submitting items for service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the website or Services. Additional written terms shown in an estimate, order confirmation, service plan, promotion, consent form, or receipt may apply to a particular transaction. If those transaction-specific terms conflict with these Terms, the more specific terms control for that transaction.
2. Eligibility and Customer Accounts
You must be at least 18 years old and legally able to enter into a contract to create an account or order Services. You agree to provide accurate, current information and to keep it updated. You are responsible for activity under your account and for safeguarding your login credentials. Notify us promptly at info@dchomeexpress.com if you suspect unauthorized account use.
We may refuse, suspend, or close an account when reasonably necessary to protect customers, prevent fraud or misuse, collect unpaid amounts, comply with law, or enforce these Terms.
3. Service Orders, Estimates, and Pricing
Prices may vary based on garment type, fabric, construction, embellishments, stain treatment, requested turnaround, alterations, repairs, pickup or delivery, and other service needs. Website prices and initial quotes are estimates unless clearly identified as final. We may revise an estimate after inspecting an item.
An online submission or scheduled pickup is a request for Services, not a guarantee that we can accept or successfully treat every item. We may decline an item or requested method when we reasonably believe the item cannot be processed safely, the service is unavailable, the care instructions are inadequate, or the request presents a safety, legal, or operational concern.
4. Customer Responsibilities
Before submitting an item, you agree to empty all pockets; remove money, jewelry, electronics, keys, pens, cosmetics, medications, and other personal property; identify valuable, delicate, vintage, specialty, or irreplaceable items; disclose known stains and their likely cause; identify preexisting damage or weak areas; provide accurate pickup and delivery instructions; and review the order count and description on your receipt or account.
You are responsible for confirming that each item belongs to you or that you are authorized to submit it. Please notify us promptly if an order record appears incomplete or inaccurate.
5. Garment Care and Inherent Risks
We use professional judgment and commercially reasonable care. We generally consider manufacturer care labels, fabric and construction, condition, stain type, and the requested service. A care label does not guarantee a successful result, and some items lack accurate or complete care instructions.
Cleaning, pressing, stain treatment, alterations, and repairs involve inherent risks. These may include shrinkage, stretching, color change or bleeding, texture change, loss of finish, weakened fibers, separation of bonded or coated materials, damage to buttons, beads, sequins, zippers, trim, leather, suede, faux leather, decorative finishes, and previously repaired areas. Age, wear, sunlight, perspiration, deodorant, perfume, household products, insects, storage conditions, and invisible residue may weaken or discolor material before we receive it.
We do not guarantee that every stain, odor, crease, or condition can be removed or corrected. Aggressive treatment may create a greater risk of damage. We may stop treatment when we reasonably believe further work could harm the item.
If you request a method that differs from the care label or our recommendation, we may decline the request or require a written risk acknowledgment before proceeding. Any acknowledgment will not waive liability that cannot lawfully be waived.
6. Delicate, Specialty, and High-Value Items
Tell us before service if an item is vintage, couture, custom-made, one of a kind, sentimental, unusually valuable, or made with specialty materials. We may require an inspection, special estimate, proof of value, separate consent, or referral to a specialist. Unless Rite Cleaners expressly agrees in writing to a declared value and special handling, ordinary service pricing does not include insurance for extraordinary or sentimental value.
7. Alterations and Repairs
Alteration and repair results depend on garment construction, fabric condition, available seam allowance, hardware, prior alterations, and the accuracy of measurements and fitting instructions. You are responsible for attending requested fittings and reviewing the agreed work. A change requested after work begins may require a revised price and completion date.
8. Pickup and Delivery
You are responsible for providing a complete, safe, and accessible pickup and delivery location, accurate access instructions, and a working telephone number. Place items in the agreed location and packaging by the scheduled time. Do not leave cash, valuables, hazardous materials, or items unrelated to the order in a pickup bag.
Pickup and delivery windows are estimates and may change because of traffic, weather, routing, staffing, item condition, service needs, or events beyond our reasonable control. We will use reasonable efforts to communicate material delays.
If you authorize unattended pickup or delivery, you accept the ordinary risk associated with the location you selected before our documented pickup and after our documented delivery, except to the extent a loss results from our negligence or another responsibility that cannot lawfully be limited. Rite Cleaners may photograph or electronically record the pickup or delivery location for order verification.
9. Turnaround Times
Completion and delivery dates are estimates unless we expressly agree in writing to a guaranteed date. Stain treatment, specialty cleaning, repairs, alterations, supply delays, re-cleaning, and third-party specialty work may require additional time. Tell us about a firm deadline before placing the order. We are not responsible for losses caused solely by an estimated completion date changing, except as required by law.
10. Payment, Card-on-File Authorization, and Taxes
You agree to pay the prices, taxes, fees, and authorized adjustments associated with your order. Payment is due. We may place a temporary authorization or charge the payment method provided in accordance with your authorization and the disclosures presented at checkout or enrollment.
If you save a payment method, you authorize our payment processor to store payment credentials and Rite Cleaners to charge that method for Services you request, amounts you approve, and other charges expressly permitted by your service arrangement. You may remove or replace a stored method through, but doing so does not eliminate charges already incurred or amounts owed.
If a payment is declined or reversed, we may request another payment method, pause future Services, and recover lawful returned-payment or collection costs that were disclosed or actually incurred.
11. Recurring Service and Automatic Charges
If Rite Cleaners offers a recurring pickup plan, subscription, membership, or automatic service arrangement, the enrollment disclosure will identify the price or pricing method, billing frequency, included Services, minimum term if any, renewal terms, and cancellation method. We will obtain your express authorization before initiating recurring charges.
12. Order Changes and Cancellations
Contact us promptly to request a change or cancellation. We may be unable to cancel an order after processing, stain treatment, alterations, repairs, routing, or specialty work has begun. You are responsible for completed work and nonrecoverable costs incurred before cancellation. Pickup or delivery changes may be subject to the disclosed fee policy.
13. Inspection, Re-cleaning, and Claims
Inspect your order promptly after pickup or delivery. Report a missing item, incorrect item, visible damage, or concern about Services within by contacting info@dchomeexpress.com. Keep the receipt, order tag, packaging, photographs, and the item in its received condition so we can investigate.
We must have a reasonable opportunity to inspect the item and order records. Depending on the circumstances, we may offer re-cleaning, correction, repair, a service credit, or another remedy. Do not arrange third-party cleaning, repair, or alteration before we inspect the item unless immediate action is reasonably necessary to prevent additional damage.
Claims are evaluated using the item’s age, condition, purchase information, reasonable useful life, depreciated fair market value, service charge, care label, preexisting conditions, and available evidence. Sentimental value and replacement with a new item are not automatically the measure of loss.
Required client decision: liability language
Insert an Arizona-attorney-approved liability formula before publication. Do not invent a multiplier or dollar cap. The final clause should explain the maximum remedy for a lost or damaged item, preserve remedies that cannot legally be limited, and align with Rite Cleaners’ insurance and claim process.
To the fullest extent permitted by law, Rite Cleaners is not responsible for damage caused by inherent defects, inaccurate or missing care instructions, ordinary wear, age-related weakness, colorfastness problems, manufacturer defects, preexisting conditions, concealed damage, or the customer’s failure to disclose material facts, except to the extent the loss was caused by our failure to exercise reasonable care.
14. Unclaimed Orders and Storage
We will use reasonable efforts to notify you when an order is ready using the contact information associated with the order. You are responsible for keeping that information current and collecting the order promptly.
Orders not collected within days after the first ready notice may incur a storage fee of , if disclosed and permitted by law. Orders remaining unclaimed after days and the notices required by Rite Cleaners’ written procedure may be treated as abandoned and donated, recycled, sold, or disposed of only to the extent permitted by applicable law. You remain responsible for completed Services and lawful fees. This section must be reviewed for compliance with Arizona law before publication or use.
15. Personal Property Left in Items
Rite Cleaners is not a storage service for personal property. We are not responsible for cash, jewelry, electronics, documents, medications, keys, or other property left in pockets, bags, or garments, except to the extent loss results from our negligence or another responsibility that cannot lawfully be limited. If we find an item, we may store it temporarily, contact you, or handle it under our lost-property procedure.
16. Promotions, Credits, and Gift Cards
Promotions, coupons, credits, loyalty benefits, and gift cards are subject to the terms presented with them. Unless prohibited by law, they have no cash value, may not be combined when stated, and may be limited by service, location, customer, or date. We may correct errors, reject fraudulent use, and end a promotion prospectively.
17. Communications
You agree that we may send service-related communications using the contact information you provide. Marketing email and text messages are subject to your consent and opt-out choices. Consent to marketing text messages is not required to purchase Services. Additional message disclosures may appear at the point of opt-in and are incorporated into these Terms.
18. Acceptable Website Use
You may use the website only for lawful personal or business purposes related to our Services. You may not interfere with website operation or security; attempt unauthorized access; submit false, harmful, infringing, or unlawful material; misuse another person’s account or payment method; scrape or copy substantial website content without permission; or use the website to commit fraud or violate another person’s rights.
19. Intellectual Property
The website and its text, graphics, logos, photographs, layout, and other content are owned by or licensed to Rite Cleaners and are protected by applicable intellectual-property laws. Rite Cleaners grants you a limited, revocable, nonexclusive right to use the website for its intended purpose. No ownership rights are transferred to you.
20. Third-Party Services and Links
The website may use or link to third-party payment, mapping, scheduling, delivery, analytics, or communication services. We do not control third-party websites or their independent terms and privacy practices. Your use of a third-party service may be subject to its own agreement.
21. Service and Website Disclaimers
Except for express written commitments and warranties that cannot legally be disclaimed, the website and Services are provided on an "as available" basis. We do not promise uninterrupted website access, error-free account functions, successful removal of every stain or odor, or a result that restores an item to new condition. Nothing in these Terms excludes the duty to perform accepted Services with the level of care required by applicable law.
22. Limitation of Liability
To the fullest extent permitted by law, Rite Cleaners will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the website or Services, including lost use or lost opportunity, when such damages may lawfully be limited. This limitation does not apply to liability that cannot legally be excluded or limited. The item-specific claim remedy must be completed in Section 13 after review by Rite Cleaners and Arizona counsel.
23. Events Beyond Our Reasonable Control
Rite Cleaners is not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, fire, flood, utility or internet failure, labor disruption, transportation interruption, government action, public emergency, supplier failure, or similar events. We will use reasonable efforts to resume affected Services.
24. Changes to These Terms
We may update these Terms from time to time. The revised Terms apply prospectively when posted, except that material changes to an existing recurring arrangement will receive any additional notice or consent required by law. The "Last updated" date identifies the most recent revision.
25. Arizona Law and Venue
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any court proceeding relating to these Terms or the Services must be brought in the state or federal courts located in , Arizona, and the parties consent to that venue and jurisdiction.
26. General Terms
If a provision of these Terms is found unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our written consent. Rite Cleaners may transfer these Terms as part of a merger, reorganization, financing, sale, or transfer of the business. These Terms, the Privacy Policy, and any applicable transaction-specific written terms form the agreement concerning the website and Services.
